Acceptance of the general terms and conditions and conclusion of the contract
The contract entered into between Bloomart S.r.l. (hereinafter "Bloomart") and the Customer (i.e. the individual or natural person who makes the purchase on the Website, not related to his/her own commercial, entrepreneurial or professional activity) shall be deemed concluded with the acceptance, even just partial, of the order by Bloomart. Partial acceptance shall be understood to mean the case in which, of a single order for several products, only the request to sell some products of the same order is accepted by Bloomart. In the event that it does not accept the order, Bloomart shall in any case promptly notify the Customer. By placing an order in the various ways provided for, as set out on the Website (hereinafter the “Order”), the Customer declares that he/she has read all the information provided during the purchase procedure and fully accepts these general conditions (hereinafter the “Conditions”), the payment conditions, the shipment conditions and the conditions for returns and refunds. These Conditions may be printed or saved on a durable medium, in compliance with the provisions of Article 12 of Italian Legislative Decree 70/2003 and Article 51 of Italian Legislative Decree 206/2005, as amended by Italian Legislative Decree 21/2014.
Methods of purchase
The products offered for sale by Bloomart are only those on the shop.cetilar.com website at the time the Order is placed, as described in the relevant product information.
In any event, it is understood that the images accompanying the product description are for information purposes only and may not be perfectly representative of the product's characteristics, and may differ e.g. in terms of colour, shape and size (also depending on the browser and monitor used to access the Website and display the images).
To place an Order, the Customer must, having carefully reviewed the Conditions, follow the on-line procedure as described in detail under Orders and Payments.
Bloomart will confirm that it has received the order successfully by means of a reply email (which the parties consider to be a valid means of communication), sent to the email address provided by the Customer during the mandatory registration process. This confirmation message will summarise the conditions of purchase, as provided for by applicable law, as well as the data entered in the Order by the Customer. Orders are processed in an automated manner and prepared a short time after they are placed, therefore Bloomart deems the information entered by the Customer when placing the Order to be true; if the Customer detects any inaccuracies, he/she should contact Customer Care, [email protected], as soon as possible so that we can attempt to correct the incorrect information. Although we will make every attempt to correct the inaccuracies, the parties agree that Bloomart shall consider said Order to be fully and tacitly confirmed in all respects by the Customer.
ORDERS AND PAYMENTS
To make a purchase, Customers must carefully follow the online procedure. Bloomart S.r.l. reserves the right to refuse or cancel an order in the event of doubts as to its veracity - incomplete or inconsistent personal data, payment defaults for previous purchases, dubious authenticity of the credit card - or in the event of product unavailability. Communication of refusal or cancellation of the order (by email or telephone) may not be timely and may also take place following subsequent contact by the Customer.
How do I make a purchase?
Shopping on this website is easy:
- Click on the desired product to access its product description and view all relevant detailed product information. Select the quantity and size (where applicable), then click on “Add to Cart” or “Buy”.
- To change the content of the cart, select Quantity. To remove the product, click “Remove” or “Delete”. Review the products placed in your cart and, to finalise your order, click on “Proceed to checkout”.

Prices and Methods of payment
Payments can be made in the following currencies: € (EUR).
The prices shown on the website are inclusive of taxes and VAT. Customers are in any case informed of any shipping costs or payment charges in advance on the order summary page of the website or in these Conditions and the aforesaid amounts will be specified in the order confirmation email.

PayPal
Customers may make payments using the PayPal circuit in accordance with its specific terms. -
Credit card
When purchasing goods using a credit card, transactions may take place through the PayPal or Stripe secure servers or other secure server chosen by Bloomart. Under no circumstances and at no stage of payment will Bloomart be privy to the information relating to the Customer's credit card, which is transmitted via secure connection directly to the website of the bank handling the transaction. Bloomart will not collect this data and no Bloomart database will store this information, therefore under no circumstances may Bloomart be held liable for any fraudulent and improper use of credit cards by third parties at the time of payment.
Payment security
Payment transactions take place on a secure page that makes use of SSL (Secure Socket Layer) certificates, a system that guarantees maximum security for online transactions. Credit card details are protected against unauthorised access by SSL encrypted data transfer, which cannot be accessed by third parties. The seller reserves the right to ask Customers to provide additional documents in order to prove they are the owner of the credit card. If these documents are not provided, the seller reserves the right not to accept the order and to proceed with a refund. Transaction security is ensured by a data encryption system (SSL) and direct, protected and certified connections.
SHIPPING
Products are shipped by the couriers: GLS, FedEx and Poste Italiane
A parcel tracking service is available for these forwarding agents. The couriers make deliveries from Monday to Friday, both morning and afternoon. The addressee may not request delivery on specific days or at specific times. If the addressee is absent, the courier will leave a failed delivery attempt notice by affixing a label at the address provided. Two attempts will be made to deliver the parcel; if neither is successful, the courier will try to contact the recipient. Bloomart shall not be liable for any malfunctions in the courier delivery service. When parcels are made to a reception (with signature for collection by the receptionist), Bloomart shall not be liable for subsequent failure to pass the package on to the addressee. If a destination country does not appear among those listed, this means that products are currently not delivered to that country. However, as Bloomart is considering extending the list of countries to which it can ship purchases, we recommend contacting [email protected] for further information.
When the products are delivered, the Customer must check
- • that the number of packages delivered matches that indicated on the delivery note;
- • that the wrapping is intact, undamaged, not wet or otherwise altered, including the sealing materials (adhesive tape or metal strapping).
Any damage to the wrapping and/or the product or inconsistencies between the number of packages and that indicated must be detected at the time of delivery, and specifically noted on the delivery note of the product to be returned to the courier.
Any problems concerning the physical integrity, consistency or completeness of the products received must be reported within 7 days of delivery by contacting the customer care service at [email protected].
Shipping costs
The cost of shipping depends on the destination country and the weight/volume of the parcel. Customers can view the cost online at the end of the order, before confirming it and proceeding to payment. Confirmation constitutes express acceptance of the entire order including the shipping cost calculated.
Shipping times
Within Italy, products will be delivered within 48-96 hours after registration of the order. For foreign countries, approximate delivery times are shown during the order conclusion stage. Any delays in delivery may be caused by the temporary unavailability of products, courier service disruptions, force majeure or holidays. If after 5 working days (excluding Saturdays and Sundays) you have still not received your goods, please contact customer care at [email protected].
The delivery times indicated by Bloomart are to be regarded as purely indicative and a delay with respect to the same, or any delivery made in successive split consignments shall not entitle the Customer to refuse the delivery and to claim damages or compensation.
Sale Conditions for Food Products and Supplements with Limited Shelf Life
In our selection of food products and sports supplements, we ensure that each product is shipped with a minimum shelf life of 40 days to guarantee our customers safe and optimal use.
Customs duties and tax
For deliveries to countries outside the European Union, any customs import charges shall be at the addressees expense. Customs duties and taxes, if any, vary according to the country of destination and are levied upon arrival of the goods in that country: customers are therefore invited to contact the customs authorities of their country in advance to check the costs and any importation limits.
In the event of rejection of the goods by the customer or non-delivery for other reasons (e.g. incorrect address and/or telephone number of the addressee; repeated absence of the addressee, etc.), the amount needed to cover the following costs: dispatch of goods + return of goods + customs for return, shall be withheld and charged to the addressee. The price of the goods, on the other hand, will be refunded.
RIGHT TO WITHDRAWAL, RETURNS AND REFUNDS
Pursuant to Article 52 of Italian Legislative Decree 206/2005, as amended by Italian Legislative Decree 21/2014, Customers may withdraw from the Conditions and therefore from the purchase contract for any reason whatsoever, without having to provide justification and without being subject to any penalty, without prejudice to the cases of exclusion provided for in the "Exclusions” section below, within 14 (fourteen) working days from the date of receipt of the products.
In order to exercise his/her right to withdrawal, the Customer must initiate the appropriate procedure through the shop.cetilar.com website and, after logging in with the username and password used at the time of purchase, must review the details of the order for which he/she wishes to withdraw, and finally click on the "Make a return" button and follow the instructions provided. It is possible to contact Customer Care at the email address: [email protected], for help initiating the return procedure.
In the event of withdrawal, the Customer must send the products to Bloomart at his/her own expense within 14 (fourteen) days of the initiation of withdrawal to the following address: PVS SERVICES ITALIA SRL, Via Romagnoli 24/26, 43056 – San Polo di Torrile (PR), Italy
The order number for which the return is being made must always be indicated inside the return package. Failure to provide this information may result in longer processing times and the impossibility to handle the return correctly. Although not mandatory, it is advisable to send the tracking details of the return shipment to the email address: [email protected], also indicating the order number for which the return is being made.
The goods must be returned undamaged, complete with all parts and in their original packaging (envelopes and packaging), stored and, if necessary, used for the time strictly necessary to establish and verify their nature, characteristics and size, in accordance with normal diligence, without any signs of wear or soiling, in compliance with the conditions set out below:
- the right to withdrawal can only be applied to a purchased product in its entirety; it is not possible to exercise withdrawal only on part of a purchased product (e.g. accessories, complements, etc.);
- for withdrawal to be possible, the product must be intact and returned in its original packaging, complete with all its parts (including packaging and any documentation and accessory equipment: labels, tags, sealing materials, etc.);
- the order number must, in any case, be provided inside the return package;
- shipping, until receipt at the warehouse designated by Bloomart has been certified, is at the sole responsibility of the Customer;
- in the event of damage to the goods during transport, Bloomart shall notify the Customer, to enable him/her to file a timely complaint against the courier chosen and obtain the relevant refund; the product shall then be made available to the Customer, at the same time cancelling the request for withdrawal;
- Bloomart shall not be liable in any way for damage, theft or loss occurring during or in connection with the return shipment.
Although Bloomart will be objective when checking and assessing the product as described above, the final judgement on the conformity and use of the product made by the Customer for the purposes of deciding whether to accept the latter’s withdrawal request will be at its sole discretion. In any event, the Customer will not incur any costs as a consequence of such reimbursement. Bloomart may suspend reimbursement until it receives the returned product or until the Customer proves that he/she has correctly returned the product, whichever is earlier.
Bloomart will refund the Customer the full amount of the returned items, within 14 (fourteen) days from receipt of the goods, which can be verified by tracking the return shipment, by means of a reversal procedure of the amount charged, using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed.
If the Customer incurred shipping costs during the purchase and if all items in the order have been returned, only standard shipping costs will be reimbursed, any costs for ancillary and/or priority shipping services will not be refunded.
In the case of partial returns, i.e. when only some items of a multiple-item order are returned, shipping costs will not be refunded.
In the case of partial returns, i.e. when only some items of a multiple-item order are returned, if the remaining order does not qualify for specific special offers, the refund will be made net of the special offer; for example, if the order was placed with free shipping for exceeding a certain threshold indicated when the order was placed, and with the return the threshold is no longer exceeded, the standard shipping costs for the country to which the order was shipped will be deducted from the refund.
In any event, the Customer forfeits the right to withdrawal in cases where Bloomart ascertains that:
- the returned product and/or its accessories, and/or its packaging are not intact;
- the product is missing from its original outer wrapping and/or inner packaging;
- the product is missing integral parts and/or accessories (e.g. seals, gadgets, accessories, etc.).
In the event of forfeiture of the right to withdrawal, Bloomart will return the purchased product to the sender, charging the shipping costs and, if already refunded, the price of the product, to the sender.
Exclusions
The right to withdrawal is excluded in the following cases, pursuant to Article 59 of Italian Legislative Decree 21/2014:
- order of Products with customised packaging or that are clearly customised;
- order of Products with customised packaging or that are clearly customised;
- order of sealed Products that are not suitable for return for hygiene or health protection reasons or that were opened after delivery.
With reference to the cases of exclusion of withdrawal listed above, the Customer, in particular, is informed and accepts that these include all food products (including supplements and beverages) and all medical devices (including creams, patches, tapes and sachets), since the characteristics and qualities of these types of Products are subject to alteration also as a consequence of inappropriate storage. Therefore, for hygiene and Customer protection reasons, the right to withdrawal is applicable only to Products purchased on the Website that can be returned to Bloomart and put back on the market without endangering consumer health (e.g. water bottles, towels, clothing, gadgets, etc.).
In cases of exclusion of the right to withdrawal, Bloomart shall return the Products purchased and returned by the Customer, charging the Customer for the return shipping costs, or dispose of them, where necessary. This charge may be deducted from the return refund, if possible.
Attention!
In the event of receipt of defective goods or other problems relating to the order, Customer Care must be contacted within one week of receipt of the order using the email address: [email protected]; the Customer Care service will assess the goods and provide instructions on the correct procedure to follow.
WARRANTIES
All products sold by Bloomart are covered by a warranty of 24 (twenty-four) months from the date stated on the purchase document for conformity defects, pursuant to Title III of Italian Legislative Decree 206/2005. To benefit from warranty service, the Customer must retain the invoice, i.e. the payment receipt, together with the delivery note.
The warranty for conformity defects applies provided that the respective product has been used correctly, in accordance with its intended use and with the instructions for use and washing provided in and/or with the product.
In the event that, for any reason, Bloomart is unable to return to the Customer a product under warranty (that has been repaired or replaced), or where the repair or replacement are, also in view of the value of the product, excessively onerous, Bloomart may proceed with an appropriate reduction of the price paid, or with reimbursement of the full amount paid with termination of the contract, depending on the state of wear and tear of the product assessed at the sole discretion of Bloomart.
In cases where the application of warranties provides for the return of the product, it must be returned by the Customer in its original packaging, complete with all its parts (including packaging and any documentation and accessory equipment).

PRIVACY
The personal data collected when the Order is placed will be processed (i.e. collected and stored) by Bloomart for the sole purpose of fulfilling the Customer's express requests, in compliance with Regulation (EU) 2016/679 and the privacy policy on the website. Any further processing will only be carried out with the express consent of the Customer.
Applicable law
The sale contract referred to in these Conditions and its execution shall be governed by Italian law, with the disapplication of the conflict of laws rules and the United Nations Convention for the International Sale of Goods. The Court of the Customer's municipality of residence shall have jurisdiction for the resolution of any disputes that may arise.
Copyright
Trademarks, logos and other distinctive signs on the website belong to their respective owners. The use of trademarks, logos and other distinctive signs, including reproduction on other websites by unauthorised third parties, is prohibited. The contents of the website are protected by copyright (text, images and graphics).
Agreement
The contract supersedes all previous contracts, agreements and understandings between the parties and constitutes the entire agreement between the parties regarding the subject matter of the contract, together with the order, the general conditions relating to the use of the website and the conditions relating to the registration service. Any change or amendment to the contract must be accepted in writing by both parties.
Correspondence
All correspondence between the parties shall be in writing and sent to the address of the other party indicated in the contract and order. Correspondence sent to the email address of the other party, indicated on the website and in the order, shall also be deemed to have been sent in writing.
Correspondence concerning the validity or existence of this agreement shall be exclusively delivered by hand or sent by registered letter with acknowledgement of receipt.
Language
The sale contract is drawn up in two versions: Italian and English. In the event of discrepancies in the translation, the Italian version shall prevail.
